GENERAL TERMS AND CONDITIONS FOR USE OF THE PALOMA FASHION ONLINE STORE

I. GENERAL PROVISIONS
These General Terms and Conditions govern the relations between KINOFF P EDPK, 208631884, with registered office and management address: Sofia, Zona B-5 residential area, block 17, hereinafter referred to as the "Retailer", and any person using the website https://paloma-fashion.com, hereinafter referred to as the "User" or "Client".
The Paloma Fashion online store provides consumers with the opportunity to browse, select and purchase the offered goods through a distance contract within the meaning of the Consumer Protection Act.
Using the website, registering a user profile and placing an order constitute agreement to these General Terms and Conditions.
If the User does not accept these General Terms and Conditions, he should discontinue using the site and not make purchases through it.

These General Terms and Conditions govern:
-using the online store;
-the rights and obligations of the Trader and the Consumer;
-the method of concluding a distance contract;
-order conditions;
-payment methods;
- terms of delivery;
-rejection of the contract;
-return of goods;
-complaints;
-processing of personal data;
-all other relationships arising from the use of the site.
IV.CHARACTERISTICS OF THE SERVICE
The online store provides users with the opportunity to:
-to view the products offered;
-to receive information about them;
-to place online orders;
-pay for orders using the offered payment methods;
-receive the purchased goods via a courier company.
The published photos of the products are for illustrative purposes only.
Minor color differences are possible due to different monitor settings, mobile device displays, and lighting during photography.
These differences do not constitute a non-conformity of the product.
V. ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS
Before completing each order, the User has the opportunity to familiarize himself with these General Terms and Conditions.
By checking the box: "I have read and accept the General Terms and Conditions"
The User declares that:
-has read the General Terms and Conditions;
-understands their content;
-accepts all clauses without objections;
-wants to conclude a distance contract with KINOFF P EDPK.
Acceptance of the General Terms and Conditions has the force of an electronic statement in accordance with the Law on Electronic Documents and Electronic Certification Services.
VI.REGISTRATION
The use of the online store is possible both after registering a user profile and without registration through the "Order as a guest" option, when available.
Upon registration, the User undertakes to provide true, accurate and up-to-date data.
The User is responsible for all actions performed through his/her profile.
Upon detection of false data or abuse, the Merchant has the right to temporarily or permanently terminate the registration of the relevant user.
VII. PLACEMENT OF AN ORDER
The order is placed by adding the selected products to the cart and filling in the necessary delivery and contact details.
Before finalizing the order, the User has the opportunity to:
-view the selected products;
-change the quantities;
-remove products from the cart;
-check the entered data;
-select a payment method.
After pressing the "Order" button (or another similar button), the User sends an offer to conclude a purchase and sale contract.
After successfully sending the order, the system automatically sends a confirmation to the specified email address.
Receiving the automatic message does not mean final acceptance of the order, but only confirms its receipt.
VIII. CONCLUSION OF THE CONTRACT
The distance selling contract is considered concluded at the moment when the Trader confirms the acceptance of the order and proceeds with its execution.
The Trader has the right to refuse to execute an order if there is a valid reason, including when:
-the product is not available;
-incomplete or incorrect data has been provided;
-there is suspicion of abuse;
-there is an obvious technical error in the price or description of the product;
-there are other objective reasons preventing execution.
In these cases, the User is notified promptly by telephone or e-mail.
IX. PRICES AND PAYMENT METHOD
All prices published in the online store are in euros (EUR) and include all applicable taxes, unless explicitly stated otherwise.
Payment can be made by:
-bank card via the secure myPOS Checkout system;
-cash on delivery, when this option is available.
When paying by bank card, the User is redirected to the secure myPOS Checkout payment page.
KINOFF P EDPK does not store and does not have access to bank card data.
All card payments are processed by the licensed payment service provider myPOS via a secure encrypted connection.
X. PRODUCT AVAILABILITY
The Merchant makes every effort to keep the information on product availability up-to-date.
It is possible that due to simultaneous orders or technical delays, a product may be out of stock.
In the event of unavailability, the Merchant will notify the customer as soon as possible.
The user may choose to:
-wait for a new delivery;
-replace the product with another;
-cancel the order.
If a prepayment has been made for a product that cannot be delivered, the amount paid will be refunded in the manner in which it was received.
XI. DELIVERY
Deliveries of ordered goods are made through licensed courier companies to the address specified by the User or to a selected courier office.
The ordered goods are handed over to a courier within 1 (one) to 3 (three) business days after confirmation of the order, unless another deadline is specified for a specific product.
After the shipment is handed over to the courier, the delivery period depends entirely on the organization and schedule of the respective courier company.
In the event of extraordinary circumstances that may lead to a delay, KINOFF P EDPK notifies the customer by phone or e-mail.
XII. RECEIPT OF THE SHIPMENT
Upon receipt of the shipment, the Consumer should carefully check:
-the integrity of the packaging;
-the number of products received;
-the conformity of the goods with the order placed.
If any visible damage, shortages or discrepancies are found, it is advisable to note them in the presence of the courier and immediately notify the Merchant.
After acceptance of the shipment without objections, it is considered that it has been delivered in visibly good condition, without limiting the consumer's legal rights in the event of hidden discrepancies.
XIII. TRANSFER OF RISK
The risk of accidental loss or damage to the goods passes to the User from the moment of their delivery.
When the goods are delivered by courier, the risk passes to the User upon receipt of the shipment.
XIV. RIGHT OF WITHDRAWAL
In accordance with Art. 50 et seq. of the Consumer Protection Act, the User has the right to withdraw from the distance contract within 14 (fourteen) days, without giving any reason.
The period begins to run from the date on which the User or a third party indicated by him receives the goods.
To exercise the right of withdrawal, the User must send an unambiguous application via:

The User may also use the Standard Withdrawal Form attached to these General Terms and Conditions, without this being mandatory.
XV.RETURN OF GOODS
After exercising the right of withdrawal, the Consumer must return the goods within 14 days.
The returned goods must be:
-without traces of use;
-without damage;
-with all original labels;
-with all received accessories;
-in the original packaging, when possible.
The Consumer is only responsible for the reduced value of the goods when it is the result of testing or use beyond what is necessary to establish its nature, characteristics and proper functioning.
Special conditions for returning clothing
The Consumer has the right to examine and try on the received goods in a manner necessary to establish their type, size and characteristics, without this leading to the loss of the right of withdrawal.
Goods that have been worn beyond the time necessary for a try-on, washed, soiled, damaged, with labels removed, with odors (perfume, cigarette smoke, etc.) or are in deteriorated commercial condition may be returned at a reduced refundable value or may not be accepted for return, where this is permissible under applicable law.
This provision does not limit the statutory rights of consumers under the Consumer Protection Act.
XVI. REFUND OF PAID AMOUNTS
After receiving and checking the returned goods, KINOFF P EDPK shall refund to the User all payments received, except in cases provided for by law.
The refund shall be made using the same payment method used in the initial transaction, unless the parties have agreed otherwise.
The refund shall be made without undue delay and no later than 14 days from the date on which the Merchant received the notification of withdrawal.
The Merchant has the right to withhold the refund until receipt of the returned goods or until proof of their dispatch is provided, whichever occurs first.
XVII. INTELLECTUAL PROPERTY
All content on the website https://paloma-fashion.com, including, but not limited to, texts, photographs, images, graphics, logos, trademarks, designs, databases and other materials, is the property of KINOFF P EDPK or is used with the relevant rights.
Without the prior written consent of the Merchant, copying, reproduction, distribution, publication, modification or use of the content for commercial purposes is not permitted.
XVIII. FORCE MAJEURE
KINOVFF P EDPK is not liable for failure to perform or delay in its obligations when this is due to extraordinary circumstances beyond the reasonable control of the Merchant, including, but not limited to:
-natural disasters;
-fires;
-floods;
-epidemics and pandemics;
-war;
-strikes;
-power outages;
-problems with internet or telecommunications services;
-actions of government authorities;
-delays by courier companies or other service providers.
When force majeure circumstances cease, the Merchant shall take the necessary actions to fulfill its obligations.
XIX. AMENDMENT OF THE GENERAL TERMS AND CONDITIONS
KINOFF P EDPK reserves the right to amend and supplement these General Terms and Conditions at any time.
All changes shall enter into force from the date of their publication on the website https://paloma-fashion.com.
Users should periodically familiarize themselves with the current version of the General Terms and Conditions.
XX. APPLICABLE LAW AND DISPUTE RESOLUTION
For all issues not settled in these General Terms and Conditions, the current legislation of the Republic of Bulgaria shall apply.
The parties will make efforts to resolve all disputes that arise through mutual understanding and good faith negotiations.
If an agreement cannot be reached, the dispute shall be referred for resolution before the competent Bulgarian court.
